These terms & conditions cannot be doubted in any way by the client unless such conditions are expressly agreed by Sebastian Th. Brune in an official written form. 

 

1. COPYRIGHT

The copyright designs and patents acts assign the copyright of the images/videos by Sebastian Th. Brune.  

 

2. DISPLAY

The client hereby allows Sebastian Brune to display any images/videos covered by this contract and to generally promote himself in advertising, brochures, magazine articles, websites, sample albums etc. 

 

3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION

Images/Videos taken during the shoot will be at the discretion of Sebastian Th.  Brune although every effort will be made to comply with the clients requirements. 

 

Special requests are not binding instruction, although every effort is made to comply with the client's wishes. Sebastian Brune will do his best to implement the requested images/videos but does not undertake any guarantee.

 

For bookings involving certain venues the movements of Sebastian Th. Brune might be restricted by the official in charge. The area from which Sebastian Brune is able to shoot might not be his first choice and he is not responsible for any obstructed view if that is the case.

Although all equipment is checked regularly and reasonable, Sebastian Th. Brune will not be responsible for images/videos that are not produced due to technical failure. 

​

4. PAYMENT

The listed costs in an offer regard to the previous negotiation and the services that will be provided. 

​

A non-refundable acceptance of an official offer will confirm a booking as well as the full acceptance of the terms and

conditions as published on Sebastian Th. Brune's website.

​

A full payment of the remaining balance will be due ten days after the shoot.

 

Additional services as extra corrections referring the cut/retouch must be paid in total ten days after ordering.

The costs of extra corrections refer to the agreed offer. Unless agreed otherwise every extra correction is charged within five percent of the original offer. 

 

The rights to all images/videos remain to Sebastian Brune until fully payed by the client.

5. FORCE MAJEURE

In terms of the improbable case of cancellation by Sebastian Th.Brune liability shall be limited by a full refund of any fees paid.

Sebastian Th. Brune will endeavour to put the client  in touch with another photographer/videographer.

​

6. DIGITAL NEGATIVE FILES

All digital negatives remain the property of Sebastian Th. Brune and are not included in any offer if not specifically discussed.

​

In case that the digital negatives will get lost, damaged of destroyed for any reason beyond control the liability of Sebastian Th. Brune shall be limited to a full refund of any deposits and fee paid, but does not include a refund of any material that has already been delivered.

8. PERSONAL ACCIDENT

Sebastian Th. Brune cannot be held responsible for any personal accidents during the shoot.

9. CANCELLATION FEES

If the client has to cancel a booking the following cancellation fees will become due immediately: 

​

Two weeks and more until the booking date: 25% of the original offer.

One week until the booking date: 50% of the original offer.

Three days until the booking date: 75% of the official offer.

Day of shoot: 100%

10. DELIVERY

The Sebastian Th. Brune will endeavour to deliver the agreed product as fast as possible. However this could take up to four to six weeks.
